I remember a discussion we were having during our injury-riddled seasons a few years back. Some of our players were getting back on the ice, only be placed back on the injury injury list after hurting themselves again shortly thereafter. This led to speculation that perhaps some of our players were being forced to play before they had completely healed from their injuries. Well, Dave Babych just won a 1.37-million-dollar lawsuit against les Flyers and Bobby Clarke. Wow! Check it out. www.canoe.ca/Slam021031/nhl_phi-ap.htmlTeam management had better think twice before suggesting to their injured players that, "...their team needs them..." the playoffs not withstanding. It will have to be the player's decision plain and simple. Cheers.

I read last week that the case against the Flyers was dismissed and that Babych carried on against the Doctor, personally. The precedent it sets is not really a precedent: the doctor's obligation is first and foremost to the patient, no matter who pays his bill...
By the way, if this was a jury verdict it stands a decent chance of being tossed or modified on appeal.

Right, here it is:
--------------------------------------------------------------------------------- Only Bartolozzi is liable for the award, since a judge had already dismissed Comcast-Spectactor as defendants, citing the lack of evidence that the team committed any fraud or misrepresentation.
"If it makes a doctor think and give the athlete an informed choice about any possible consequences, regardless of whether it's the playoffs or the Super Bowl, then it will have done some good," said Patrick D'Arcy, Babych's lawyer. ----------------------------------------------------------------------------------
