Report details Craig's disorderly conduct

CNN has obtained the June 11, 2007 police report detailing Idaho Sen. Larry Craig's disorderly conduct arrest in an airport bathroom.

In the report, the arresting officer alleges that Craig lingered outside a restroom stall where the officer was sitting, then entered the stall next door and blocked the stall door with his luggage. (Read the report [PDF])

According to the report, Craig tapped his right foot, which the officer said he recognized "as a signal used by persons wishing to engage in lewd conduct."

"Craig tapped his toes several times and moved his foot closer to my foot," the report states. "I moved my foot up and down slowly. While this was occurring, the male in the stall to my right was still present. I could hear several unknown persons in the restroom that appeared to use the restroom for its intended use. The presence of others did not seem to deter Craig as he moved his right foot so that it touched the side of my left foot which was within my stall area."

At that point, the officer said he put his police identification down by the floor so Craig could see it, and informed the senator that he was under arrest, before any sexual contact took place.

Craig, who agreed to plead guilty to disorderly conduct, denied to the officer he was engaging in any inappropriate activity.

According to the report, Craig told the police that "he has a wide stance when going to the bathroom and that his foot may have touched mine [the officer's]."

I do not see where any law was broken. Furthermore, I am perplexed as to Craig's plea!

Exactly ....

I'd think the officer was more in violation of the law. He had suspicions about a person and moved his foot "up and down" ... me thinks thats cop talk for "closer". Thats intrapment in my books.

Even if Craig wa sin that stall playing "free willy" ... how can it be disorderly conduct, or anything unless there is absolute proof as to what he was doing?

The only explanantion I'll accept is that it was known to the local police force that gay men were passing signals (tap your foot) to ask for sex. If someone complained about it (say a straight man who unbeknownst to himself gave the correct counter signal) after being approached .... well ok ... but it still isn't disorderly conduct. As far as I know it is not against the law to ask anyone for sex (no matter the method), as long as you take no for an answer.

Craig: I did nothing 'inappropriate' in airport bathroom

(CNN) -- Sen. Larry Craig said he "overreacted and made a poor decision" in pleading guilty to disorderly conduct after his June arrest following an incident in a Minneapolis, Minnesota, airport bathroom.


Tuesday, in his first public statement on the arrest, the Idaho Republican said he did nothing "inappropriate."

"Let me be clear: I am not gay and never have been," said Craig, who has aligned himself with conservative groups who oppose gay rights.

With his wife by his side, Craig said he is the victim of a "witch hunt" conducted by the Idaho Statesman newspaper.

"In pleading guilty, I overreacted in Minneapolis, because of the stress of the Idaho Statesman's investigation and the rumors it has fueled around Idaho," he said. "Again, that overreaction was a mistake, and I apologize for my misjudgment."
